Licence terms
Overview
Everything Felt Instruments sells is licensed to you, not sold. That covers the plugins themselves and all the sounds and content that come with them. The licence is personal, and cannot be transferred without written consent from Felt Instruments.
Felt Instruments is Tomasz Piskor-Ślesicki, based in Milanówek, Poland. You buy through Polar, the merchant of record, under its buyer terms; the licence itself comes from Felt Instruments under the terms below. By downloading a Felt Instruments plugin, you agree to them.
Polish law applies. If you are a consumer, you also keep the protections of the law of the country you live in.
- what you may do
- Use the plugins and their sounds in music and audio you make, for yourself or for a client. Personal or commercial, released anywhere, with no further fees.
A client is a person or company you can name, who commissioned the work from you: an artist, a producer, a label, a film, a game, an agency, an institution. The finished piece can be sold, streamed, broadcast or performed without limit. Sound design counts as a finished piece too: a Felt sound cut into a game, a film or an installation is fine.
Install the plugins on as many machines as you personally use, and make copies for that use. The licence itself stays with you and is not shared with anyone else. - loops, samples and kits
- The one thing the licence does not allow is passing the sounds on as sounds. You may not release, sell, give away or upload loops, samples, one-shots, stems, construction kits, presets, or any other pack in which the Felt sounds are the product. On their own or layered, dry or processed, for money or for free. That includes marketplaces and subscription libraries such as Splice, Loopcloud or LANDR, and any stock or royalty-free sound library, and it applies whoever asked you to make the pack.
The test is simple. If what you hand over is a finished piece of music or audio, it is fine. If what you hand over is material for other people to make music with, it is not.
The effect plugins are different. Running the Felt Instruments effects plugins over your own loops and recordings, and releasing those, is fine: the processed audio is yours. The restriction covers the sampled sounds that come with the instruments. - the demo licence
- The free trial installs as a demo licence, which is what your DAW lists it under. It allows the plugins to be used for testing only. To publish work made with them, you need a full (paid) licence.
- what you may not do
- Copy or redistribute the plugins or their content, in whole or in part, whether sold or given away. This includes file-sharing services: uploading licensed content to one ends your licences immediately.
Re-use or re-package any of the content in another virtual instrument, sample library, sound-effect library, or loop, preset or effect library. Loops, samples and kits, above, says what that means in practice.
Reverse-engineer, decompile or crack the plugins, or remove or work around their licence checks.
Use any of the content to train AI or machine-learning models.
Pass your licence to another person without written consent from Felt Instruments. - transferring a licence
- A licence can be sold to a new owner, who is then entitled to use the plugins. Four things happen, in this order.
1. You write to Felt Instruments before the sale, and the transfer is agreed in writing.
2. You pay a flat transfer fee of 5% of the plugin’s full price.
3. Felt Instruments moves the licence to the new owner.
4. You remove every plugin file from any machine it was installed on. - refunds
- You buy from Polar, the merchant of record. Polar takes the payment and issues any refund, and its buyer terms govern the payment itself. This row says when a refund is due.
At checkout you confirm that delivery starts at once, and that you give up the 14-day right of withdrawal on a digital download. Delivery happens when your download code is redeemed. Once it has been redeemed, the licence cannot be returned or exchanged.
If you have not redeemed your code, nothing has been delivered: get in touch within 30 days of purchase and the order is cancelled and refunded in full.
If a plugin does not work as described and I cannot fix it, you get your money back. Your statutory rights as a consumer are unaffected. - responsibility
- You use the plugins and their content at your own risk. To the extent the law allows, Felt Instruments is not liable for indirect loss, lost profits or lost data arising from their use, and its total liability is limited to what you paid for the plugin concerned. Nothing here limits liability that cannot be limited by law, or your statutory rights as a consumer.
- ai & machine learning
- In short: nothing I release may be used to train an AI or machine-learning model without my written permission. The formal wording follows.
As a copyright holder, I hereby make a reservation of my rights for the purpose of all activities constituting text and data mining. The reservation applies to all works, in which I hold copyright (author’s economic rights), to the extent that such works comprise, in whole or in part, any type of disseminated content.
Any acts of text and data mining carried out in relation to content that includes works, in which I hold copyright, without obtaining my authorisation shall constitute an infringement of my rights. The plugins released by Felt Instruments, and all of the associated content cannot be used to train AI models without written permission of Felt Instruments.
